COVID-19 Stimulus Checks

April 16, 2020
As per the language of the CARES Act, we are not seeking turnover of these funds as additional income in Chapter 13 cases.

Guidelines for §341 Adjournment Requests

April 8, 2020
When seeking an adjournment of the §341 Meeting of Creditors, please ensure all income documentation has been submitted to [email protected] prior to sending your request.  Cases where all income verification documents required by LBR 2003-2(c) have not been provided will be marked as not held/not adjourned.  Once documents have been submitted, you may contact our office for new dates; otherwise, new dates will be addressed at the confirmation hearing.
 
If your client is unable to attend the §341 meeting and all documents have been submitted, you must contact our office no later than the Tuesday prior to the hearing with your request.  Our office will supply new dates in a stipulation.  You may either print, sign and scan to return the document, or give permission in an email to sign on your behalf.  If you miss the Tuesday deadline for requesting a formal adjournment in advance, you may still advise our office that you or your client will be unable to attend.  The meeting will be marked as not held/not adjourned and an adjournment can be requested any time after the original hearing date up to the time of confirmation.

New Judge Assignment

November 18, 2019

Effective November 19, 2019, new cases assigned to Judge Shefferly filed on or after this date will be assigned to either David Ruskin or Krispen Carroll based upon the following end digit:

7-9  Krispen Carroll

**Please note this is a different number assignment from all pending cases as of November 18, 2019.  All cases filed on or before November 18, 2019 will remain with the assigned trustee on the date of filing.

​Judge Randon Courtroom Procedure

November 29, 2017

As many of you may know, Judge Randon has altered his procedure for confirmation adjournments.  Please carefully review the information below for details.  If you should have any questions regarding the new procedure, please feel free to send your questions by email directly to Krispen Carroll – [email protected].

120 Day Confirmation Adjournments - effective 10/11/17

All Pre-Confirmation cases requiring adjournments will be given dates of at least 120 days from the date of the original hearing.  After all necessary amendments and document submission to address trustee and creditor issues have been completed, debtor attorneys should email the assigned legal assistant with a proposed OCP requesting the case be reviewed for confirmation prior to the scheduled hearing date.  Upon receipt and review of an OCP where all outstanding creditor and trustee issues have been resolved, the Trustee will submit the case for confirmation prior to the adjourned hearing date.   
 
Please note that such email should be sent only after expiration of any notice periods and the signature of any objecting creditors have been obtained.  Requests for confirmation should not accompany a production of documents to the Trustee.  The normal time for review of documents and the filing of any supplemental objections should have passed prior to requesting a confirmation review.  Payment history and funding requirements for early confirmation review are unchanged.  Please include a plan calculation with the OCP to reflect any changes in payments or creditor treatment included in the OCP.   

During the 120 days the Trustee’s office will be monitoring payments and reviewing documents received, but will not be pursuing confirmation absent a request from debtor counsel.  Responses to requests for early confirmation can be expected to be received within 14 days of receipt.  If the Trustee, debtor and objecting parties are in agreement a legal issue requires determination prior to the adjourned hearing date, the matter may be set for an earlier date on the contested call by stipulation.     

ACH Agreement Form Updated

The ACH Agreement form has been updated. Debtors may now select the 28th of the month as a withdrawal date, in addition to the 5th and 17th.
